Public and government outrage over recent tax fraud and tax shelter cases led to significant changes in the preparer penalty laws under the Small Business Work Opportunity Act of 2007. This study experimentally examines the effectiveness of the revised preparer penalty provisions at reducing tax preparer aggressiveness. Specifically, we examine the impact of two significant components of the changes to the preparer penalty provisions - the increase in penalty amount and the increase in the likelihood of sustaining the tax position (...) required to avoid penalty imposition (required likelihood threshold) - on tax preparers’ willingness to (1) recommend an uncertain position and (2) sign a tax return containing an aggressive position. The results suggest that both the increase in penalty amount and the increase in required likelihood threshold reduce tax preparers’ willingness to recommend an uncertain position and/or sign a tax return containing an aggressive position. Of the two components, the results indicate that the increase in required likelihood threshold is more effective at reducing tax preparer aggressiveness than the increase in penalty amount. Congress may want to rethink its recent decision to reduce the required likelihood threshold for many of the decisions that tax preparers make with their clients. (shrink)

I.WhatVintage ofCivilRights?In this paper I wish to compare and contrast two separate conceptions of civil rights and to argue that the older, more libertarian conception of the subject is preferable to the more widely accepted version used in the modern civil rights movement. The first conception of civil rights focuses on the question of individual capacity. The antithesis of a person with civil rights is the slave. But even if individuals are declared free, they are nonetheless denied their civil rights (...) if they are unable to own property, to enter into contracts, to make wills, to give evidence, and to sue (and be sued) in courts. With all these civil rights claims, the target of the individual grievance is the state; it has denied large classes of individuals the formal capacities that it recognized and protected in others. The Civil War was fought largely over slavery. In its aftermath, civil rights claims protecting individual capacity received explicit, if imperfect, statutory and constitutional protection. The postbellum protections didnotguarantee these rights in absolute fashion – that is, in a way that would not be susceptible to abridgment under any circumstances. Instead, civil rights were protected in what might be called a relative fashion: whatever rights of this sort were enjoyed by white citizens were to be enjoyed by the newly freed black citizens as well. Since literary historian Robert Bone published his seminal essay ‘Richard Wright and the Chicago Renaissance’ in 1986, scholars have created new cartographies of previously unexplored terrain in American cultural history. The earliest studies focused on literature, but more recently attention has turned to other disciplines, including visual arts. Recent publication of The Muse in Bronzeville: African American Creative Expression in Chicago, 1932–1950 (2011) by Robert Bone and Richard A. Courage promises to decisively broaden scholarly understandings of the scope (...) and significance of Chicago-centred cultural production during the Great Depression and post-war years. Of particular relevance to contemporary studies of new media art is the manner in which then-emergent ideas and practices – centring on racialized subject matter, elite and mass audiences, traditional and new mediums of expression, private vs public sponsorship, and passive vs active reception of art objects – converged to create new paradigms and possibilities for visual artists to reshape consciousness in a period of institutional collapse and change. Chicago’s New Negro artists of the 1930s and 1940s, like their counterparts in 1920s Harlem, sought to reframe perceptions of African American life, to re-present the black subject as something other than an object of contempt or amusement beneath the privileged gaze of the white viewer. Just as these artists sought to revise perceptions of racial reality, examination of the wide range of actual images they created and the mediums and styles they explored revises reductive notions about creative expression in this period, which often portray a mere subordination of art to propaganda and an embrace of representational aesthetics and simplistic narratives in a fruitless detour in the evolution from modernism to postmodernism. On the contrary, Andrew Hemingway notes the range of stylistic experiment and characterizes so-called ‘social art’ as ‘a hybrid and unstable mode [which] had to carry the imperative to be an art equal in formal achievement to both the great art of the past and the modern tradition … [and] to suggest a political orientation without becoming overt revolutionary propaganda’ (2002).New media theorist Oliver Grau observes thatIn many quarters, virtual reality is viewed as a totally new phenomenon… but it did not make its first appearance with the technical invention of computer-aided virtual realities. On the contrary, virtual reality forms part of the core of the relationship of humans to images… grounded in art traditions that have receivedscant attention up to now.(2004)In the midst of another period of change, of transformed and transforming ideas and practices in the arts, we have much to learn from the attempts of Chicago’s New (Media) Negro artists to create ‘art for the people’, to immerse broad audiences in such accessible media as mural painting, photography and graphic arts. Historically, for Black writers, literary fiction has been a site for transforming the discursive disciplinary spaces of political oppression. From 19th century “slave narratives” to the 20th century, Black novelists have created an impressive literary counter-canon in advancing liberatory struggles. W.E.B. Du Bois argued that “all art is political.” Many Black writers have used fiction to create spaces for political and social freedom—from the early work of Harriet Wilson’s Our Nig; or, Sketches from the Life of a Free Black (1859)—to (...) the enduring works of the Harlem Renaissance (Toomer, Hurston, and Schuyler)—to the great revolutionary Black literature after WWII (Wright, Baldwin, Williams)—to contemporary Black writers (Toni Morrison, Edward Jones, Samuel Delany)—Black fictive space continues to be a necessary site for resistance. Black literary fiction is a vast counter-canon to mainstream literature which unquestioningly reinforces global white supremacy, capitalistic political oppressions, and the dominance/subordinance relations upon which they depend. This is a memorial essay on how the life and work of Charles W. Mills influenced my development as a Black philosopher. Employing Mills’s use of the Jamaican creole term smadditizin’—meaning “becoming recognized as somebody in a world where, primarily because of race, it is denied”—I trace how Mills helped me become a human self myself. Inspired by using his books as texts in courses I taught, and working with him in the Radical Philosophy Association, I learned what it means (...) to be an engaged philosopher. This essay also explores the controversy surrounding radical Black liberalism as a means for attaining personhood. Finally, I defend Mills as a canonical radical philosopher who never wavered from his fierce anti-colonialist, anti-white supremacist, and anti-capitalist stances. (shrink)

The language of “participant-driven research,” “crowdsourcing” and “citizen science” is increasingly being used to encourage the public to become involved in research ventures as both subjects and scientists. Originally, these labels were invoked by volunteer research efforts propelled by amateurs outside of traditional research institutions and aimed at appealing to those looking for more “democratic,” “patient-centric,” or “lay” alternatives to the professional science establishment. As mainstream translational biomedical research requires increasingly larger participant pools, however, corporate, academic and governmental research programs (...) are embracing this populist rhetoric to encourage wider public participation. We examine the ethical and social implications of this recruitment strategy. We begin by surveying examples of “citizen science” outside of biomedicine, as paradigmatic of the aspirations this democratizing rhetoric was originally meant to embody. Next, we discuss the ways these aspirations become articulated in the biomedical context, with a view to drawing out the multiple and potentially conflicting meanings of “public engagement” when citizens are also the subjects of the science. We then illustrate two uses of public engagement rhetoric to gain public support for national biomedical research efforts: its post-hoc use in the “care.data” project of the National Health Service in England, and its proactive uses in the “Precision Medicine Initiative” of the United States White House. These examples will serve as the basis for a normative analysis, discussing the potential ethical and social ramifications of this rhetoric. We pay particular attention to the implications of government strategies that cultivate the idea that members of the public have a civic duty to participate in government-sponsored research initiatives. We argue that such initiatives should draw from policy frameworks that support normative analysis of the role of citizenry. And, we conclude it is imperative to make visible and clear the full spectrum of meanings of “citizen science,” the contexts in which it is used, and its demands with respect to participation, engagement, and governance. In The Heart of Wisdom, White examines spiritual concepts like generosity, suffering, and joy, incorporating the various perspectives of great philosophers, including Nietzsche, Aristotle, and Derrida, as well as Eastern wisdom traditions, including Buddhism and Vedanta philosophy.

Among Western philosophers, Schopenhauer is one of the few who seeks to clarify the nature of music, and its effects upon us. He claims that music is the most important of all the arts; and he argues that music is a kind of metaphysics that allows us to experience the ultimate reality of the world. In this essay, I evaluate Schopenhauer’s philosophy of music in the context of his overarching philosophy. Then I discuss the relevance of traditional Indian philosophies -- (...) including Advaita Vedanta and Buddhism -- which Schopenhauer recognized as forerunners to his own philosophical system. Here, the discussion of Om is particularly important. Schopenhauer’s discussion of music is insightful. But his insistence on the priority of the will is problematic. I suggest another perspective on willing, ultimate reality and music which follows the classical Indian philosophies that he affirms. (shrink)

Richard White shows how Nietzsche was inspired and guided by the question of personal "sovereignty" and how through his writings sought to provoke the very sovereignty he described. White argues that Nietzsche is a philosopher our contemporary age must therefore come to understand if we are ever to secure a genuinely meaningful direction for the future. Profoundly relevant to our era, Nietzsche's philosophy (...) addresses a version of individuality that allows us to move beyond the self-dispossession of mass society and the alternative of selfish individualism - to fully understand how one becomes what one is. In this paper, I examine Foucault’s ideas concerning the care of the self. What exactly is this ideal that Foucault describes in his last two books? Do these books represent a break or a continuation with the earlier writings on knowledge and power? Most important, I consider whether the care of the self could ever be a significant ethical ideal given some of the objections that have been raised against Foucault’s position. I also look at the care of the self (...) as the focus of Foucault’s own views on spiritual life. I argue that Foucault’s later work offers the basis for a secular or non-theistic spirituality which is especially relevant today. (shrink)

In particular, I look at the three maxims on compassion that help to organise Rousseau's discussion, and the precise strategy that Emile's tutor uses to instil compassion while avoiding other passions, such as anger, fear and pride. The very idea of an education in compassion is an important one: Rousseau's discussion remains relevant, and he has correctly understood the significance of compassion for modern life. But (...) in linking compassion to self-interest, he creates a tension between Emile's natural sentiments, including compassion, as a way of bringing him into the social order. In this paper, I focus my attention on I and Thou as an important text in the philosophy of religion which goes beyond the traditional opposition of theism and atheism by proposing a different way of thinking about God and the nature of religious belief. I begin with a basic account of Buber’s position in Part One of I and Thou, and then I move on to the philosophy of God in Part Three which is built upon this initial discussion. (...) In the rest of the paper, I examine some of the implications of Buber’s perspective for the meaning of “belief in God” and how this affects traditional theism and atheism. My sense is that I and Thou has been very influential, but in recent years it has been unfairly neglected. One of the goals of this paper is to show that I and Thou is still important, for as a singular text that transcends the ordinary boundaries of philosophy, theology, and literature it remains compelling and appeals to many who have different religious beliefs, as well as those who have none. In this paper, I look at three different perspectives on mourning in recent European thought. First, I consider Freud's discussion in “Mourning and Melancholia” and other writings. Next, I look at Roland Barthes, whose book on photography, Camera Lucida, is itself a work of mourning for his late mother; and Jacques Derrida, who in Memoires for Paul de Man and The Work of Mourning memorializes departed friends and describes the ambiguities of mourning that constrain us. I argue that Freud was (...) mistaken: mourning is not structured in terms of investment and loss. Barthes and Derrida clarify the complexities of mourning, but mourning is intractable and resists all sublimation: It is for the self, but it is also for the departed, who is neither “present” nor “absent” in the ordinary sense of these terms. Hanging on and letting go are both inappropriate responses to bereavement – how then should we mourn? (shrink)

In lieu of an abstract, here is a brief excerpt of the content:390 HUME'S DIALOGUES AND THE COMEDY OF RELIGION Laughter is the key to Hume's Dialogues Concerning Natural Religion. Indeed, I would suggest that if the Dialogues have not made one laugh, and if one has not experienced the sheer delight of Hume's rhetorical excesses and gaiety, then one hasn't really understood this work at all. From this perspective, the usual questions are irrelevant — Is Hume Cleanthes or Philo? (...) Is Philo a mitigated sceptic or a Pyrrhonian? Such debates are sterile and miss the point, for however consistent or inconsistent the characters may be, the actual drama of the text has an intention and a direction all of its own, destroying the religious hypothesis not so much by 'serious' calculated argument as by ridicule and excess. Hume's Dialogues Concerning Natural Religion are the expression of a healthy and cheerful malice which strives at every turn to intensify the sense of the absurdity of religion. Hence their flavour is primarily rhetorical, and it would be a mistake to consider them as merely a collection of paraphraseable proofs directed against the possibility of rational theology. This is not to say, however, that Hume did not take religion seriously; on the contrary, he uses all of the devices of comedy in order to overwhelm it — rather as Nietzsche was to argue: "Not by wrath does one kill but by laughter. ml In this paper, I will consider the rhetorical aspect of Hume's Dialogues to show how the literary mode — the elaboration and contrast of characters, the use of parody and sudden turns in the plot, etc. — enables Hume to make a far more compelling assault on the religious hypothesis than the plain recital of 391 'reasonable' objections would ever achieve. I will focus my discussion on three central themes: First, the professed acceptance of God by all of the participants, and the consequent need for an oblique attack upon religion; second, Hume's comic perspectives on the argument from Design; and third, Hume's development of an 'antinomies of religion,' whereby the various religious arguments are used to undermine each other. 1. The Belief in God No man; no man, at least of common sense, I am persuaded, ever entertained a serious doubt with regard to a truth so certain and self-evident. The question is not concerning the being but the nature of God. Ostensibly, the one thing that is never questioned in the Dialogues, the one thing that all the participants remain agreed upon, is that God exists. Indeed, it seems that however limited the scope of natural theology may turn out to be, the actual being of God can never be in dispute, for in the Dialogues, belief in God is often presented as if it were an unchallengeable 'given' of human experience. Cleanthes, for example, apparently follows Locke in arguing for the reasonableness of theism; and yet, when he is pressed he defends the Design hypothesis in terms of its psychological irresistibility, appealing to a natural sentiment of belief rather than the claim of any argument: Consider, anatomize the eye: Survey its structure and contrivance; and tell me, from your own feeling, if the idea of a contriver does not immediately flow in upon you with a force like that of sensation.... it requires time, reflection and study, to summon up those frivolous, though 392 abstruse, objections, which can support infidelity (D 154). According to Cleanthes, the Design hypothesis is so self-evident that it really does not need any philosophical justification at all. It is simply the articulation of what we all already knew to be true: The comparison of the universe to a machine of human contrivance is so obvious and natural, and is justified by so many instances of order and design in nature, that it must immediately strike all unprejudiced apprehensions, and procure universal approbation (D 216). Demea also denies that religion is based upon argument. He claims that each man is brought to feel the truth of religion within himself through the consciousness of his own complete ignorance and misery. What is God? What does it mean to believe in God? What happens to God after the death of God? This book examines “the death of God” from a philosophical standpoint. ABSTRACT This article looks at several sections of Minima Moralia where Adorno talks explicitly about the need for genuine thinking and what that might consist in. First, I argue that Hegel and Nietzsche are the two guiding thinkers behind this work, and I show how they express two opposing tendencies of thinking—aphoristic and dialectical—that can inspire and enhance each other. Then, in the main part of the article, I identify four significant claims in Adorno’s critical reflections on thinking: (1) that (...) thinking is the enemy of common sense; (2) that thinking is not the same thing as problem-solving; (3) that thinking is not inherently linear in nature; and (4) that thinking involves lingering with the particular or allowing the other to be. I conclude that Adorno’s reflection on the difficulty of thinking in modern life is a key to his account of philosophy in the contemporary world. (shrink)

I argue that Nietzsche's philosophy is focussed upon the issue of autonomy and what it means to be a "sovereign individual." In this respect, Nietzsche is directly in the tradition of Kant who first valorized autonomy as the only proper foundation of moral life. As a "philosopher of the future," however, Nietzsche goes beyond Kant in describing as well as provoking the end of sovereignty.

Generosity and gift-giving are important themes in Nietzsche's philosophy. This essay focuses on Nietzsche's idea of the gift-giving virtue which is explicitly discussed at the end of Part One of Thus Spoke Zarathustra. I begin with a critical discussion of this section, and then I consider three different interpretations. Finally, I look at some ways in which the idea of the ‘gift-giving virtue’ may be understood in terms of spiritual generosity, leading to ‘sovereignty’ as its ultimate goal. The artist Francis Bacon frequently depicted the open screaming mouth in his powerful paintings. But according to Lessing's classic work, _Laocoon, a scream is inherently ugly and a "blot on a painting productive of the worst possible effect." The conjunction of Lessing and Bacon is clearly a provocative one and it can tell us much about the fortunes of contemporary aesthetics.

It is tempting to think that we have heard just about all we want or need to know about race. As the above quotes indicate, modern notions of race have always revolved around the faculty of vision, with supplementary contributions from other senses such as hearing, as Arendt notes in a tacit allusion to one mark of Jewish difference—the way they sounded when concentrated in urban settings. Yet two very recent works—Mark M. Smith's How Race Is Made and Anne C. (...) Rose's Psychology and Selfhood in the Segregated South —have much to teach us about how race has “worked”, particularly in the twentieth-century South but also, by implication, in the United States in general. Both works assume that, historically, race is no mere add-on to the self, a kind of externality that, once detected, can be relatively easily excised. Rather, it stands right at the heart of personal and group identity in a nation where race and ethnicity continue to assume surprising new shapes and forms. (shrink)

Andrew Dickson White played a pivotal role in constructing the image of a necessary, and even violent, confrontation between religion and science that persists to this day. Though scholars have long acknowledged that his position is more complex, given that White claimed to be saving religion from theology, there has been no attempt to explore what this means in light of his overwhelming attack on existing religions. This essay draws attention to how White's role as a historian (...) was decisive in allowing him to posit a future for religion purified of dogma by science. It argues, furthermore, that this effort is better understood as religious innovation, rather than a plea for strictly secular science. In so doing it hopes to lay the foundation for a more fruitful historical treatment of White, and a range of other figures whose devotion to science has otherwise been difficult to grasp. (shrink)

Researchers from across the social sciences have found consistent deviations from the predictions of the canonical model of self-interest in hundreds of experiments from around the world. This research, however, cannot determine whether the uniformity results from universal patterns of human behavior or from the limited cultural variation available among the university students used in virtually all prior experimental work. To address this, we undertook a cross-cultural study of behavior in ultimatum, public goods, and dictator games in a range of (...) small-scale societies exhibiting a wide variety of economic and cultural conditions. We found, first, that the canonical model – based on self-interest – fails in all of the societies studied. Second, our data reveal substantially more behavioral variability across social groups than has been found in previous research. Third, group-level differences in economic organization and the structure of social interactions explain a substantial portion of the behavioral variation across societies: the higher the degree of market integration and the higher the payoffs to cooperation in everyday life, the greater the level of prosociality expressed in experimental games. Fourth, the available individual-level economic and demographic variables do not consistently explain game behavior, either within or across groups. Fifth, in many cases experimental play appears to reflect the common interactional patterns of everyday life. We would like to thank the commentators for their generous comments, valuable insights and helpful suggestions. We begin this response by discussing the selfishness axiom and the importance of the preferences, beliefs, and constraints framework as a way of modeling some of the proximate influences on human behavior. Next, we broaden the discussion to ultimate-level (that is evolutionary) explanations, where we review and clarify gene-culture coevolutionary theory, and then tackle the possibility that evolutionary approaches that exclude culture might be sufficient (...) to explain the data. BackgroundMany authors choose to work with professional medical writers when reporting the results of clinical trials. We conducted a systematic review to examine the relationship between professional medical writing support (PMWS) and the quality, ethics and timeliness of publications reporting clinical trials.MethodsUsing terms related to ‘medical writer’ and ‘observational study’, we searched MEDLINE and Embase (no date limits), as well as abstracts and posters from meetings of the International Society for Medical Publication Professionals (ISMPP; 2014–2018). We also hand-searched the journals (...) Medical Writing and The Write Stuff (2014–2018) and the bibliographies of studies identified in the electronic searches. We screened the results to identify studies that compared the quality, ethics and timeliness of clinical trial publications written with and without declared PMWS.ResultsOur searches identified 97 potentially relevant studies, of which 89 were excluded during screening and full paper review. The remaining eight studies compared 849 publications with PMWS with 2073 articles developed without such support. In these eight studies, PMWS was shown to be associated with increased adherence to Consolidated Standards of Reporting Trials (CONSORT) guidelines (in 3/3 studies in which this was assessed), publication in journals with an impact factor (one study), a higher quality of written English (one study), and a lower likelihood of reporting non-pre-specified outcomes (one study). PMWS was not associated with increased adherence to CONSORT for Abstracts guidelines (one study) or with the impact of published articles (mean number of citations per year, mean number of article views per year and Altmetric score; one study). In studies that assessed timeliness of publication, PMWS was associated with a reduced time from last patient visit in clinical trials to primary publication (one study), whereas time from submission to acceptance showed inconsistent results (two studies).ConclusionsThis systematic review of eight observational studies suggests that PMWS is positively associated with measures of overall quality of reporting of clinical trials and may improve the timeliness of publication.Video abstract.
